1. Overview
KAIROS ("we," "us," or "our") operates an AI-powered marketing platform accessible at kairos-ai.co. We offer subscription-based access to our AI marketing services, including content generation, planning, scheduling, and distribution tools. This Refund Policy outlines the terms governing billing, cancellations, and refund eligibility for all paid subscriptions.
2. Free Trial Period
- KAIROS offers a 7-day free trial to new users, allowing you to explore the platform and its capabilities before committing to a paid subscription.
- A valid payment method (credit or debit card) is required to start the trial. When you begin your trial, we charge a one-time $1 USD card verification fee to confirm that the card is valid. This $1 verification fee is non-refundable.
- Aside from the $1 verification fee, no further charges are made during the trial period.
- You may cancel your trial at any time before it expires from your account settings. If you cancel before the trial ends, your subscription will not convert to a paid plan and you will not be charged the subscription fee.
- If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan and your payment method will be charged at the applicable rate.
3. Subscription Billing
- All KAIROS subscriptions are billed on a monthly recurring basis. Payments are processed securely through Stripe.
- Subscription fees are charged at the beginning of each billing cycle.
- Pricing is determined on a per-project, per-month basis. The total amount charged depends on the number of active projects associated with your account.
4. Cancellation Policy
- You may cancel your subscription at any time from your account settings within the KAIROS platform.
- Upon cancellation, you will continue to have access to the platform and all subscription features until the end of your current billing period.
- No partial refunds are issued for unused time remaining within a billing cycle, except where required by applicable law (see Section 6 for EU consumer rights).
5. Refund Eligibility
KAIROS does not offer a general satisfaction-based money-back guarantee for paid subscriptions. Refunds are limited to the specific circumstances listed below. Consumers located in the EU/EEA retain a statutory 14-day right of withdrawal as described in Section 6 — this is required by law and applies independently of the categories below.
Eligible for Refund
- Service Outages. Pro-rata refunds are available for verified service outages exceeding 72 continuous hours that materially prevent you from using the platform.
- Duplicate or Erroneous Charges. Full refunds are issued for any charges made in error, including duplicate billing or incorrect amounts.
Not Eligible for Refund
- The $1 USD card verification fee charged at the start of your free trial. This fee is non-refundable under any circumstances.
- Partial month usage after cancellation. Cancelling mid-cycle does not entitle you to a pro-rata refund for the remainder of the current billing period.
- Dissatisfaction with the quality of AI-generated content, as outputs may vary based on inputs and use case.
- Issues arising from third-party platforms (e.g., social media API changes, outages, or restrictions) that are outside of KAIROS's reasonable control.
6. EU Consumer Rights (14-Day Right of Withdrawal)
If you are a consumer located in the European Union or European Economic Area (EU/EEA), you are entitled to a 14-day cooling-off period from the date of your first subscription purchase, in accordance with the EU Consumer Rights Directive (Directive 2011/83/EU).
- During this 14-day period, you may request a full refund regardless of how much you have used the service.
- If you requested that the service begin immediately during the withdrawal period and subsequently exercise your right of withdrawal, a proportionate amount may be charged for the service already provided up to the point of withdrawal.
- To exercise your right of withdrawal, send an email to [email protected] with the subject line "Right of Withdrawal." Include your account email address and the date of your subscription purchase.
7. How to Request a Refund
To request a refund, please email us at [email protected] and include the following information:
- The email address associated with your KAIROS account.
- The reason for your refund request.
- Relevant subscription details, including the date of charge and, if applicable, the project name.
We will acknowledge your request and respond within 5 business days. Approved refunds are processed within 10 business days and returned to the original payment method used at the time of purchase.
8. Chargebacks
We strongly encourage you to contact us directly at [email protected] before initiating a chargeback or payment dispute with your bank or payment provider. We are committed to resolving billing issues promptly and fairly.
Please be aware that initiating a chargeback may result in temporary suspension of your KAIROS account pending the outcome of the investigation. We reserve the right to permanently suspend accounts involved in fraudulent or unjustified chargebacks.
9. Changes to Pricing
- We will provide at least 30 days' advance notice before any changes to subscription pricing take effect. Notification will be sent via email to the address associated with your account.
- Your current billing cycle will be honored at the existing price. The new pricing will take effect on your next renewal date after the 30-day notice period has elapsed.
- If you do not agree with the new pricing, you may cancel your subscription before the new rate takes effect.
10. Force Majeure
KAIROS shall not be liable for any failure or delay in performing its obligations under this policy where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, pandemics, power outages, internet infrastructure failures, or acts of third parties. No refunds will be issued for service interruptions attributable to force majeure events.
